OAZO HOMES SERVICES AG - General Terms and Conditions

Oazo Homes Services AG · Goethestrasse 12, 8001 Zurich, Switzerland · hello@oazohomes.com

Version 2 – October 2026 · Effective from 1 December 2026. This version replaces the Terms and Conditions version 1.0 of 30 July 2025. The Rental Terms (Annex 1) and the Host Guidelines (Annex 2) form part of these GTC. This English version is a convenience translation; the German version prevails (clause 9.4).

Preamble

Oazo Homes Services AG («Oazo») operates oazohomes.com, a curated, invitation-based platform for renting selected holiday homes (the «Platform»). Access is granted to persons who have been invited by an existing club member and confirmed by Oazo.

These GTC govern the relationship between Oazo and the users of the Platform as well as the contractual framework within which hosts and guests conclude rental contracts for properties. They are divided into nine parts: General, Club Membership, Hosts, Platform, Data Protection, Liability, Force Majeure, Dispute Resolution and Final Provisions. Two annexes form part of the contractual framework: the Rental Terms (Annex 1), which govern the rental relationship between hosts and guests, and the Host Guidelines (Annex 2), which specify the operational requirements for hosts and properties.

1. General

1.1 Scope and contracting party

These GTC govern the use of the platform oazohomes.com operated by Oazo Homes Services AG, Goethestrasse 12, 8001 Zurich («Oazo»). They apply to all persons who access or use the Platform. By using the Platform, users accept these GTC. Use is reserved for persons aged 18 or over.

1.2 Definitions

  • «Platform»: the website oazohomes.com.
  • «Properties»: the real estate offered for rent on the Platform as holiday accommodation within the meaning of Art. 253a para. 2 of the Swiss Code of Obligations (CO).
  • «Hosts»: club members who offer a property on the Platform.
  • «Guests»: club members who book a property through the Platform.
  • «Club members»: investors, hosts, members of the Oazo team and the guests invited by them or by authorised distribution partners.
  • «Rental Terms»: the Rental Terms in Annex 1 which, together with the booking confirmation and the property description, form the rental contract between host and guest.
  • «Host Guidelines»: the Host Guidelines in Annex 2.
  • «Oazo Maniero»: the six principles for living together in the Oazo Club, published at oazohomes.com/en/la-oazo-maniero. Club members acknowledge the Oazo Maniero upon registration.

1.3 Role of Oazo

Oazo provides the Platform and acts as an intermediary between hosts and guests. The rental contract for a property is concluded exclusively between the host and the guest and is governed by the Rental Terms (Annex 1); Oazo is not a party to this rental relationship (see clause 6.3).

1.4 Amendments to the GTC

Oazo may amend these GTC. Material changes are announced to club members by e-mail at least 30 days before they take effect. Anyone who does not wish to accept the amended GTC may terminate their membership with ordinary notice before the effective date. Continued use of the Platform after the deadline constitutes acceptance of the amended GTC. The current version and previous versions are available on the Platform.

2. Club Membership

2.1 Access and admission

Access to the Platform is granted exclusively upon invitation by an existing club member or by a distribution partner authorised by Oazo, and after review and confirmation by Oazo. All confirmed club members may invite trusted persons as guests; details and any maximum numbers are set out in clause 3.2. There is no entitlement to admission; Oazo decides at its due discretion and informs the applicant of a rejection, briefly stating the main reasons.

2.2 Duty of truthfulness

Club members are obliged to complete their user profile truthfully. False statements made to hosts or the Oazo team with intent to deceive may result in sanctions up to and including exclusion from the Club (see clause 4.8).

2.3 Club fee

Club membership is currently free of charge. If Oazo introduces a fee for additional services in the future, Oazo will give at least 60 days' notice by e-mail of the amount, the introduction date and the associated membership tiers. After receiving this notice, club members may remain in the Club free of charge or leave without further notice. Once the fee is introduced, memberships are organised in tiers; depending on the tier, members receive access to different special and additional services. Anyone who remains a member after the fee is introduced accepts the corresponding fee arrangement.

2.4 Referral of third-party properties

Anyone who refers a third-party property to the Platform which is subsequently admitted receives a holiday credit of CHF 150 to be set off against their own Oazo platform fee on their next booking. The credit cannot be paid out and is valid for 12 months from the date it is credited.

2.5 Obligations of guests

Guests provide truthful information when booking and comply with the rules set for the respective property, in particular the maximum occupancy (number of overnight guests), the minimum length of stay, the pet policy and the check-in and check-out times (see clauses 3.7, 3.13, 3.14). They treat the property and its furnishings with the care that can be expected of a tenant and leave it in the condition in which they found it; normal wear and tear excepted.

2.6 Booking and payment

Bookings and payments are made exclusively through the Platform (see clause 4.1). By submitting a booking request, the guest makes a binding offer to conclude the rental contract and remains bound by it for 48 hours; in doing so, the guest accepts the Rental Terms (Annex 1) and the house rules of the property. The rental contract is concluded upon receipt of the booking confirmation. A confirmed booking is binding on both guest and host. Guests pay the nightly rate, the cleaning costs and a platform fee of 10% (see clause 4.2). If a host requires a deposit for a property, clause 3.8 applies in conjunction with the Rental Terms.

2.7 Cancellation by guests

Refunds in the event of cancellation by guests are governed by the cancellation policy chosen by the host for the respective property in accordance with clause 3.9.

2.8 Termination of membership

Guests may end their membership at any time by deleting their account. Bookings already in progress remain subject to the cancellation policies of the respective hosts. Oazo may terminate a guest's membership with 30 days' notice or, in the event of breaches of these GTC, without notice. Bookings already confirmed continue as planned after termination and remain subject to the cancellation policies of the respective hosts; in the event of termination without notice for good cause, Oazo may additionally cancel ongoing bookings.

3. Hosts

3.1 Admission of properties

Properties are admitted only upon invitation or recommendation from within the Club and after review by Oazo; there is no entitlement to admission. Oazo decides on admission at its due discretion and informs the applicant of a rejection, briefly stating the main reasons. The relevant admission criteria are set out in the Host Guidelines (Annex 2), which form part of the agreement between Oazo and the host.

3.2 Right to invite

Hosts may invite up to 30 trusted persons per year as guests. Investors and Oazo team members have the same right to invite to the same extent.

3.3 Responsibility and Host Guidelines

Hosts are responsible for the operation of their property, in particular for correct and up-to-date listing content, compliance with all local laws, permits and official requirements (including registration obligations and tourist taxes), the organisation of cleaning and key handover, prompt responses to guest enquiries and the acceptance or rejection of booking requests within 48 hours. Booking requests are sent to hosts by e-mail and, by default, also by SMS; SMS delivery can be disabled in the settings. Before deciding, hosts may view the profile of the requesting person. Further operational requirements regarding the furnishing and service of a property are set out in the Host Guidelines (Annex 2), which form part of the contract.

Hosts provide Oazo with all information required for the fulfilment of its legal obligations, completely and truthfully, and indemnify Oazo against third-party claims and official sanctions arising from a breach of these obligations.

3.4 Insurance

Hosts maintain adequate insurance cover for damage in connection with the rental of the property and provide Oazo with proof upon request. Properties without adequate insurance cover may be excluded from the Platform.

3.5 Safety of the property

Hosts ensure that their property can be used safely and that the applicable safety and fire-protection regulations are complied with. Recommendations on safety equipment are set out in the Host Guidelines (Annex 2); the safety equipment available must be stated in the property description.

3.6 Digital access

Hosts manage the calendar, prices and property description via the Oazo host dashboard. They choose a booking horizon of 12, 18 or 24 months, keep the calendar up to date within this period, enter blocked dates immediately to avoid double bookings, and maintain seasonal prices. Through the messaging tool, hosts communicate with guests, invite club members and see booking requests, booking confirmations and the revenue generated.

3.7 Prices and length of stay

Hosts set the nightly rate freely (seasonal, per day or per number of persons) as well as the minimum and maximum length of stay for their property; seasonal variations are possible. The maximum length of stay per booking is 90 nights (see clause 1.2, «Properties»). Bookings can be made at least 2 days and at most within the booking horizon chosen under clause 3.6 in advance. Any tourist taxes are collected on site or included in the price; they must be stated in the property description.

3.8 Deposit

Hosts may require a deposit of at most CHF 2,500 per booking for their property. The amount, method of payment and refund arrangements must be stated in the property description. The deposit is collected, held and refunded by the host independently; Oazo is not involved in handling the deposit. The details, in particular the deadlines for reporting damage and refunding, are governed by the Rental Terms (Annex 1, clause 6).

3.9 Cancellation policies

Hosts choose one of the following cancellation policies for their property:

  • Flexible: free cancellation up to 14 days before check-in; 50% refund up to 4 days before check-in; no refund from 3 days before check-in.
  • Moderate: free cancellation up to 30 days before check-in; 50% refund up to 7 days before check-in; no refund from 6 days before check-in.
  • Firm: free cancellation up to 50 days before check-in; 50% refund up to 14 days before check-in; no refund from 13 days before check-in.
  • Strict: free cancellation up to 50 days before check-in; 50% refund up to 30 days before check-in; no refund from 29 days before check-in.

The cancellation policy chosen for the property at the time of booking applies; a later change by the host only affects new bookings.

Hosts may cancel a confirmed booking only for good cause. Good cause includes in particular: serious illness or death of the host or a close relative, unforeseeable significant damage to the property (fire, water damage, burglary), official bans on use and force majeure events under clause 7. In the event of the host's death, the cancellation may be made by an authorised person or an heir. A cancellation without good cause constitutes a breach of contract by the host. In this case the guest receives a full refund of all booking costs including the platform fee; Oazo may additionally charge the host a handling fee of CHF 150. Further claims of the guest remain reserved.

3.10 Payment and payout

Oazo processes all payments through the payment service provider Stripe. Payouts are made in CHF, EUR or USD; other currencies are available on request. The payout is released 24 hours after check-in and comprises the nightly rate less the Stripe fee and the service fee, plus the cleaning costs. The Stripe fee corresponds to the costs charged by Stripe (currently around 2.9% plus CHF 0.30 per transaction) and is passed on without mark-up. Cleaning costs are shown on the Platform and settled through the Platform; settlement with the cleaning staff is the host's responsibility. Other mandatory additional costs and tourist taxes are collected by the host independently; they must be clearly stated in the property description, including the accepted means of payment. Hosts receive an annual statement for their tax return by the end of January.

3.11 Service fee

Unless otherwise agreed, Oazo charges hosts a service fee of 4% on the accommodation costs per rental. Creating the listing and admission to the Platform are free of charge; there are no set-up or subscription fees. The purpose of the fees charged by Oazo is summarised in clause 4.2.

3.12 Price display and value added tax

The prices displayed to guests on the Platform are final prices in the stated currency and include all non-optional surcharges, including any value added tax (VAT) and the platform fee (Art. 10 et seq. of the Swiss Price Indication Ordinance). Tourist taxes are shown separately unless they are included in the price. In the relationship between Oazo and hosts, Oazo's fees are exclusive of any VAT. Hosts bear sole responsibility for the VAT treatment of their rental income under the law applicable to them, in particular the Swiss VAT Act or, for properties in the EU, the EU VAT Directive.

VAT on Oazo's fees for properties in the EU. The platform fee (clause 4.2) and the service fee (clause 3.11) are remuneration for Oazo's intermediary service. For properties located in an EU member state, these fees are subject to the VAT of the state in which the property is located. Oazo declares and pays this VAT through the EU One-Stop-Shop procedure (non-Union scheme) and shows it on the receipts. For hosts who qualify as VAT-registered businesses in their state of residence, the reverse-charge mechanism applies to the service fee; in this case the tax liability passes to the host. The VAT status declared by the host (private individual or business with a valid VAT identification number) is decisive. Hosts declare their status truthfully, report changes without delay and authorise Oazo to verify a stated VAT number through the EU VAT Information Exchange System (VIES). The information required for the declaration (in particular the member state of the property, the fee and tax amounts and, where applicable, the host's VAT number) is transmitted to the competent tax authorities as part of Oazo's legal obligations (clauses 5.3 and 9.1).

3.13 Pets

Hosts state the pet policy (allowed, not allowed or on request) in the property description. Guests declare pets in the booking request. Undeclared pets may lead to the immediate termination of the stay and to an additional cleaning charge (Rental Terms clause 3.4).

3.14 Check-in and check-out

Hosts set the check-in and check-out times in the property description. If none are stated, the following applies: check-in from 3 p.m., check-out by 12 noon. Deviations are agreed directly between hosts and guests via the Platform.

3.15 Legal obligations

Hosts independently check and comply with all regulations relevant to the operation of the property, in particular permits, registration and licensing requirements for tourist rentals, noise protection, fire protection and data-protection rules. Upon request by Oazo, they provide evidence of existing permits or licence numbers. The responsible party is liable for breaches; Oazo accepts no liability for legal consequences arising from non-compliance with official requirements by hosts or guests.

3.16 Termination of the cooperation

Hosts may terminate their cooperation with Oazo at any time. Oazo may terminate the cooperation with 30 days' notice, stating the reasons. Termination without notice by Oazo is permitted where a legal or regulatory obligation so requires, in the event of repeated or serious breaches of these GTC, the Host Guidelines or the Oazo Maniero, or for other good cause within the meaning of Art. 4 para. 4 of Regulation (EU) 2019/1150. Bookings already confirmed continue as planned after termination; from receipt of the notice of termination, the host no longer accepts new bookings. If a confirmed booking cannot take place for reasons for which no party is responsible (in particular natural events or damage to the property), the guest receives a full refund of all payments made, including the platform fee.

3.17 Tax reporting obligations (DAC7)

As a platform operator, Oazo is subject to the reporting obligations of Council Directive (EU) 2021/514 («DAC7») for the rental of properties located in the EU and for hosts resident in the EU. As a platform operator without an establishment in the EU, Oazo is registered, or in the process of registering, with the Irish tax authority (Office of the Revenue Commissioners); reports are filed there and forwarded by the Irish tax authority to the tax authorities of the member states in which the host is resident or the property is located. The fact that the Platform is operated as a closed club does not alter this reporting obligation.

Affected hosts provide Oazo with the required information completely and keep it up to date, in particular: name or company name, main address or registered office, date of birth, tax identification number(s) with issuing state, any VAT number, commercial register number, any permanent establishments in the EU, the address and, where available, the land-registry or cadastral reference and type of the property, and the bank account used for payouts. Oazo collects this information via the host dashboard, verifies it (including a format check of the tax identification number and verification of the VAT number via VIES) and may use it for further reports within the statutory periods; hosts report changes without delay. Oazo reports the information required by law, including the remuneration credited per quarter, the number of rentals and rental days and the fees withheld by Oazo, annually by 31 January for the previous year to the competent tax authority, and provides each reported host with a statement of the information transmitted by the same date.

If a host fails to comply with the duty to cooperate after two reminders and the expiry of 60 days, Oazo is entitled and, where applicable, obliged to withhold payouts, deactivate the listing or block the account until the information has been provided. Further details are set out in the Host Guidelines (Annex 2, clause 3).

4. Platform

4.1 Bookings and payments through the Platform

All bookings of properties, including the extension of a booked or ongoing stay, and the associated payments are made exclusively through the Platform. Exceptions are tourist taxes collected on site, the additional costs stated in the property description (clause 3.10) and additional services that are not offered through the Platform. If a booking or extension is processed by circumventing the Platform, the host is liable to Oazo for the platform fees lost as a result (guest and host share). A confirmed booking is binding on both parties.

4.2 Fees and payment processing

Oazo charges guests a platform fee of 10% of the nightly rate (see clause 2.6) and hosts a service fee of 4% (see clause 3.11). With these fees Oazo finances the further development of the Platform, marketing and communication, the support of club members and the curation of new properties. At a later date, Oazo may charge hosts and club members additional fees for additional services; these will be communicated transparently in advance. For VAT on the fees, see clause 3.12.

Collection agency. Oazo receives all payments from guests as a disclosed collection agent in the name and for the account of the respective host and processes refunds on their behalf through the payment service provider Stripe. Payment to Oazo releases the guest from their payment obligation towards the host to the corresponding extent. Oazo does not provide any accommodation service and does not become a party to the rental contract by processing payments.

4.3 Content

By providing content (texts, photos, videos), hosts grant Oazo a non-exclusive, worldwide, royalty-free licence to use it for platform, marketing and communication purposes, unless otherwise agreed in writing. The licence applies for the duration of the membership and for three years thereafter for content already published; disclosure to third parties requires the express consent of the host. Oazo has editorial control over the presentation of the properties on the Platform, including the selection of images, the order of images (storytelling) and the cover image. Hosts remain the owners of the rights to their content; Oazo coordinates materially significant changes with them. Hosts are responsible for the legality of their content and the corresponding copyrights. Content is used outside the Platform (external communication such as newsletters, social media, press) only if the host has expressly consented; if a host objects to external use, Oazo respects this and does not include the property concerned in external communication.

To experience and inspect the property and its surroundings and to produce its own marketing content (photo, video, editorial), hosts provide Oazo, on request, with up to two free overnight stays on a one-time basis; in this case Oazo covers the cleaning costs. Further stays are subject to agreement. Details are set out in the Host Guidelines (Annex 2, clause 11).

4.4 Calendar synchronisation

If a host also rents a property through other platforms, the host synchronises the booking calendar via the iCal link provided by Oazo; the host is responsible for this. If the other platform does not support the iCal standard, the host ensures synchronisation by other means. Further requirements regarding the currency of the calendar are set out in the Host Guidelines (Annex 2, clause 5).

4.5 Order of search results

The order of search results is not weighted according to commercial criteria. Without a selected sort order, properties are displayed in a random order that is reshuffled daily; when a filter by number of guests is active, properties with the smallest suitable capacity are shown first, and in a map-area search, properties are ordered by proximity to the centre of the map section. The searching person may additionally sort the results by price or capacity (ascending or descending). Paid influence on the order is not provided for. Should Oazo introduce paid placements in the future, the relevant parameters and any influence of payments on the ranking will be disclosed transparently in advance.

4.6 Reviews

Guests and hosts may rate stays towards Oazo. This feedback is not published; Oazo uses it confidentially to ensure and improve service quality. Incidents may be reported confidentially to Oazo at any time. Should Oazo introduce a public review function in the future, Oazo will inform club members and hosts in advance about its design.

4.7 Conduct on the Platform

Club members treat each other respectfully and honestly, maintain truthful profile information and treat the personal data of other club members confidentially. The Oazo Maniero (clause 1.2), the acknowledgement of which is a prerequisite for registration, governs conduct within the Club. Repeated or serious breaches of the Oazo Maniero may result in measures under clause 4.8.

4.8 Measures and objection

If Oazo takes measures against published content (e.g. property descriptions or profile content) or against a club member (e.g. restriction or exclusion), Oazo informs the person concerned in writing without delay of the nature of the measure, the reasons and the applicable provision of these GTC.

Oazo seeks a conversation with the person concerned; the outcome and legally relevant points are recorded in writing. The person concerned may object in writing to hello@oazohomes.com within 14 days of receipt of the notification and set out the reasons why the measure is considered unjustified. Oazo examines the objection and communicates the result in writing within 30 days; the decision is taken by a person who was not involved in the original measure.

Existing bookings remain unaffected during the objection procedure. The procedure does not affect the right of club members to take legal action under clause 8.

5. Data Protection

5.1 Principle

Oazo processes personal data of club members in accordance with the Swiss Federal Act on Data Protection (FADP) and, where applicable, the EU General Data Protection Regulation (GDPR). Details, in particular the categories of data processed, the legal bases, retention periods, transfers abroad and the rights of data subjects, are set out in the privacy policy at oazohomes.com/en/privacy-policy.

5.2 Allocation of roles

Oazo and the hosts are each independent controllers. The host is responsible for the personal data of guests received in the context of a booking (e.g. name, contact details, stay details). The host processes this data exclusively for the handling of the stay and the fulfilment of legal obligations (e.g. registration forms, tourist taxes), treats it confidentially and deletes it afterwards.

5.3 Transfers abroad and reporting obligations

In the context of payment processing, data is transmitted to the payment service provider Stripe. Transfers to the USA are based on the statutory safeguards under Art. 16 et seq. FADP or Art. 46 GDPR (standard contractual clauses) or on a certification under the Swiss–U.S. or EU–U.S. Data Privacy Framework.

To fulfil tax reporting and declaration obligations, Oazo transmits the host information referred to in clauses 3.12 and 3.17 and the associated booking and payout data to the Irish tax authority (DAC7 report, One-Stop-Shop declaration). The Irish tax authority forwards this information to the tax authorities of the competent EU member states. The legal basis is Oazo's statutory obligation; the data is retained for as long as the tax retention periods require. Hosts are informed of the purpose when the data is collected and receive an annual statement of the information reported (clause 3.17). For disclosure to authorities in general, see clause 9.1.

6. Liability

6.1 Liability of Oazo

Oazo is liable for direct damage (immediate financial loss) caused by gross negligence or intent on the part of Oazo. Liability for slight negligence is excluded to the extent permitted by law (Art. 100 CO). Consequential damage, loss of profit, indirect damage and loss of data are not covered. Where there is a connection to a specific booking, Oazo's total liability is limited to the value of that booking; where there is no such connection, it is limited to CHF 5,000. These limitations do not apply to personal injury or to gross negligence and intent; further mandatory statutory liability, in particular under applicable data-protection law, remains reserved.

6.2 Liability for third-party content

Oazo is not liable for third-party content or linked third-party websites, including their accuracy, subject matter, quality or currency.

6.3 Role as intermediary

Oazo acts as an intermediary between hosts and guests and is not a party to the rental relationship, which is governed by the Rental Terms (Annex 1). Oazo is therefore not liable for the accuracy of property descriptions, the availability of properties or the quality of the services provided by hosts.

6.4 Liability of hosts

Hosts are fully liable for damage caused to guests or third parties by a breach of their obligations under these GTC and indemnify Oazo against corresponding third-party claims.

6.5 Liability of guests

The liability of guests towards hosts for damage to the property and its furnishings is governed by the Rental Terms (Annex 1, clause 9).

6.6 Right of withdrawal for consumers from the EU

Consumers resident in the European Union generally have a 14-day right of withdrawal for distance contracts (Directive 2011/83/EU). Bookings of holiday accommodation for a specific period are expressly excluded from this right of withdrawal under Art. 16(l) of that Directive. The right of withdrawal must not be confused with a right of cancellation; cancellations are governed exclusively by the cancellation policies under clause 3.9.

7. Force Majeure

7.1 Principle

No party is liable for the non-performance of its contractual obligations to the extent that this is due to a force majeure event that is beyond the control of the affected party, was not foreseeable and could not have been averted with reasonable care. This provision applies to all parties, including Oazo. If Oazo processes a refund as a result of force majeure, it acts as a collection agent; this does not make it a party to the rental contract.

7.2 Examples

Force majeure includes in particular natural disasters (earthquakes, floods, wildfires, extreme weather conditions), epidemics or pandemics insofar as they make the stay actually or legally impossible (in particular through government-ordered travel restrictions), war, terrorism, riots or government intervention, officially ordered closures of properties and complete power or communication failures. Large-scale power or communication failures only count as force majeure insofar as they are not within the area of responsibility of a party or a service provider engaged by it.

7.3 Procedure

The affected party informs the other party and Oazo within 7 days of becoming aware. Bookings are cancelled free of charge upon presentation of appropriate evidence; the guest receives a full refund of all payments made, including the platform fee. The reversal by Oazo is carried out as a collection agent and does not establish a contracting-party position.

8. Dispute Resolution

8.1 Internal conciliation

In the event of problems or disputes, Oazo Support mediates in the first instance. For disputes arising from the rental relationship, in particular regarding deposits, damage and individual agreements, the contact point hello@oazohomes.com is available (Rental Terms clause 11). Objections to measures taken by Oazo against published content or against a club member may be raised in accordance with clause 4.8.

8.2 Out-of-court dispute resolution

If disputes cannot be resolved internally, Oazo is willing, without being obliged to do so, to participate in proceedings before recognised conciliation or mediation bodies; such proceedings may be conducted in writing or online. In Switzerland there is no statutory conciliation body for disputes arising from the use of the Platform. The European Online Dispute Resolution platform (ODR platform) was discontinued on 20 July 2025; Oazo is not obliged to participate in proceedings before consumer dispute resolution bodies in the EU and decides on voluntary participation on a case-by-case basis.

8.3 Place of jurisdiction and applicable law

These GTC are governed by Swiss law, excluding its conflict-of-law rules. The place of jurisdiction is Zurich. Mandatory places of jurisdiction and mandatory consumer law remain reserved. Consumers resident in Switzerland may sue at the court of their domicile and may only be sued there (Art. 32 and 35 of the Swiss Civil Procedure Code). Consumers resident in a state bound by the 2007 Lugano Convention are entitled to the place of jurisdiction at their domicile under Art. 15–17 of the Lugano Convention; for actions before the courts of an EU member state, Art. 17–19 of Regulation (EU) No 1215/2012 remain reserved. Mandatory provisions of the law of the consumer's habitual residence remain unaffected.

9. Final Provisions

9.1 Disclosure to authorities

Hosts acknowledge and agree that Oazo is entitled and, where required by law, obliged to disclose all information necessary for the fulfilment of its legal obligations to the competent authorities. This includes in particular the tax reports and declarations under clauses 3.12 and 3.17 to the Irish tax authority and, through it, to the tax authorities of the competent EU member states, as well as information provided to Swiss authorities on a legal basis. Oazo informs the hosts concerned of the information reported insofar as the law provides for and permits this.

9.2 Assignment

Club members may not assign their rights, obligations or claims in connection with these GTC without the prior consent of Oazo. Oazo may transfer rights and obligations under these GTC to a company of the same group; club members will be informed in advance.

9.3 Severability

Should any provision of these GTC be wholly or partly unlawful, invalid or otherwise unenforceable, the remaining provisions remain unaffected and in full force.

9.4 Prevailing language version

These GTC are drawn up in German. Translations serve solely for ease of understanding; in the event of discrepancies, the German version prevails.

9.5 Third-party content

The Platform may contain third-party content or links to third-party websites. Oazo accepts no responsibility for these (see clause 6.2).

9.6 Annexes

The following form part of these GTC: Annex 1 – Rental Terms; Annex 2 – Host Guidelines.
