Rental Terms (valid from December 1st 2026)

Annex 1 to the General Terms and Conditions of Oazo Homes Services AG

Version 1 – October 2026 · Effective from 1 December 2026. Applicable to all bookings concluded via oazohomes.com. This English version is a convenience translation; the German version prevails (clause 14.2).

Preamble

These Rental Terms govern the contractual relationship between the host and the guest regarding the temporary stay in a property booked via the platform oazohomes.com («Platform»). Together with the booking confirmation and the property description, they form the rental contract between host and guest. Oazo Homes Services AG, Goethestrasse 12, 8001 Zurich («Oazo»), is not a party to this contract. Oazo provides the Platform, brokers the conclusion of the contract and processes payments as the disclosed collection agent of the hosts (clause 5). Oazo's General Terms and Conditions (GTC) additionally apply to the use of the Platform.

1. Parties and conclusion of the contract

1.1 The parties to this contract are exclusively the host named in the booking confirmation and the booking guest. Oazo owes no accommodation service and is not liable for the performance of this contract.

1.2 By submitting the booking request via the Platform, the guest makes a binding offer to conclude this contract and remains bound by it for 48 hours. The contract is concluded when the host accepts the request within this period and the guest receives the booking confirmation. Oazo transmits the booking confirmation on behalf of the host.

1.3 The contract consists of (in this order of precedence): documented individual agreements under clause 1.4, the booking confirmation, the property description including house rules at the time of booking, and these Rental Terms.

1.4 Individual agreements: If host and guest agree, in connection with a booking, on supplementary arrangements or arrangements deviating from the property description (e.g. additional services, restricted availability of individual amenities, different check-in or check-out times), these become part of the rental contract if they are documented via the Platform's messaging tool or recorded in the booking confirmation. Documented individual agreements take precedence over the property description and these Rental Terms; later agreements take precedence over earlier ones. Agreements made by telephone or outside the Platform are confirmed by the parties via the messaging tool for evidentiary purposes. Paid additional services remain permissible insofar as they are not offered via the Platform (GTC clause 4.1); restrictions of the booked offer require the express consent of the guest.

2. Subject of the contract

2.1 The host provides the guest with the property, furnished and equipped, for a temporary holiday and recreational stay. This constitutes the rental of holiday accommodation within the meaning of Art. 253a para. 2 of the Swiss Code of Obligations (CO); the rental period is at most three months (90 nights). For properties outside Switzerland, mandatory provisions of the law of the place where the property is located remain reserved (clause 12).

2.2 The stay establishes neither residence nor a permanent tenancy. Subletting, transfer for consideration and use for purposes other than holidays are excluded.

3. Persons, use and house rules

3.1 The property may only be occupied by the persons stated at the time of booking and by no more than the number of persons stated in the property description.

3.2 The guest complies with the house rules of the property, in particular the rules on pets, smoking, quiet hours and the check-in and check-out times. Events and parties are only permitted with the prior written consent of the host; a corresponding permission in the house rules counts as such consent. Guest and host treat each other in the spirit of the Oazo Maniero (GTC clause 4.7).

3.3 The guest treats the property and its furnishings with care and leaves it in the condition in which it was found; normal wear and tear excepted.

3.4 Undeclared pets, over-occupancy or unauthorised events entitle the host to terminate the stay immediately without refund of the unused nights, to the extent permitted by law, and to charge an additional cleaning fee in accordance with the property description (GTC clause 3.13). If the property description does not state an amount, the cleaning fee for use in breach of contract is CHF 500. Further claims for damages remain reserved (clause 9).

4. Price and tourist taxes

4.1 The guest owes the total price stated in the booking confirmation. This comprises the nightly rate, the cleaning costs, any tourist taxes included in the price and the Oazo platform fee in accordance with the GTC. The platform fee is the remuneration for Oazo's intermediary service and may include VAT depending on the location of the property; it is shown separately on Oazo's receipt (GTC clause 3.12).

4.2 Tourist taxes not included in the price and mandatory additional costs stated in the property description are collected on site in accordance with the property description.

5. Payment via Oazo (collection agency)

5.1 All payments under this contract are made exclusively via the Platform; excepted are the deposit (clause 6) and tourist taxes and additional costs collected on site (clause 4.2). The host authorises Oazo to receive payments from the guest in the name and for the account of the host and to initiate refunds (disclosed collection agency).

5.2 Payment to Oazo releases the guest from their payment obligation towards the host to the corresponding extent.

6. Deposit

6.1 If the property description provides for a deposit (at most CHF 2,500 per booking), the host collects it directly from the guest. The amount, method of payment and due date are set out in the property description and repeated in the booking confirmation. Oazo is not involved in the collection, safekeeping or refund of the deposit.

6.2 No damage: If the host does not claim any damage within 48 hours after check-out, the deposit is refunded in full no later than 7 days after check-out. In the event of damage: The host claims damage from the guest within 48 hours after check-out and documents it (description, photos, cost receipt or quote). The deposit is refunded no later than 7 days after check-out, less the documented damage; if the damage exceeds the deposit, the host reserves the right to claim the excess (clause 9).

6.3 If the guest disputes a deduction, Oazo mediates in accordance with clause 11 (hello@oazohomes.com); both parties retain the right to pursue the matter in court.

7. Cancellation

7.1 By the guest: The cancellation policy stated in the property description applies (Flexible, Moderate, Firm or Strict according to the scale valid at the time of booking, GTC clause 3.9). The time at which the cancellation is received on the Platform is decisive. A subsequent change of the cancellation policy by the host does not apply to bookings already confirmed.

7.2 By the host: The host may cancel a confirmed booking only for good cause (in particular serious illness or death of the host or a close relative, unforeseeable significant damage to the property, official bans on use, force majeure); in the event of the host's death, the cancellation may be made by an authorised person or an heir. In this case the guest receives a full refund of all payments made via the Platform. A cancellation without good cause constitutes a breach of contract by the host; the guest receives a full refund of all payments made, including the platform fee, and reserves further claims (GTC clause 3.9).

7.3 No EU right of withdrawal: Consumers resident in the EU have no 14-day right of withdrawal, as accommodation contracts with a specific performance period are excluded from it (Art. 16(l) of Directive 2011/83/EU). The cancellation policies under clause 7.1 apply exclusively.

8. Obligations of the host; defects

8.1 The host makes the property available at the agreed check-in in a contractually compliant, cleaned and safe condition and is answerable for the accuracy of the property description.

8.2 The guest reports defects to the host without delay via the Platform. The host remedies significant defects within a reasonable period, as a rule within 24 hours of the report, insofar as this is possible and reasonable. The guest's statutory rights in respect of defects (Art. 258 et seq. CO or the mandatory law of the place where the property is located) remain reserved.

9. Liability

9.1 The booking guest is liable to the host for damage to the property and its furnishings caused during the stay by the guest or their fellow travellers; the guest is liable for the conduct of fellow travellers as for their own (Art. 101 CO).

9.2 In all other respects, the liability of the parties is governed by law. Liability for personal injury and for gross negligence and intent can be neither excluded nor limited (Art. 100 CO).

9.3 Claims under this contract are directed exclusively against the respective contracting party. Oazo is not liable for the performance of this contract; Oazo's liability arising from the platform relationship is governed by the GTC.

10. Force majeure

If the stay cannot take place as a result of a force majeure event (as described in the GTC), the booking is cancelled free of charge upon presentation of appropriate evidence; the guest receives a full refund of all payments made via the Platform, including the platform fee (see also GTC clause 7.3).

11. Disputes and mediation

In the event of disputes arising from this contract, in particular regarding deposit deductions, damage or individual agreements, both parties may contact Oazo's contact point (hello@oazohomes.com); Oazo mediates between the parties where possible, without being obliged to do so and without decision-making authority. The ordinary legal process remains unaffected.

12. Applicable law and place of jurisdiction

12.1 This contract is governed by the law of the state in which the property is located.

12.2 The place of jurisdiction is the place where the property is located. Mandatory places of jurisdiction, in particular for consumers at their domicile (Art. 32/35 of the Swiss Civil Procedure Code; Art. 15–17 of the 2007 Lugano Convention; Art. 17–19 of Regulation (EU) No 1215/2012), remain reserved.

13. Relationship to the GTC; authorities

13.1 Oazo's GTC govern the relationship of the parties with Oazo (use of the Platform, fees, payment processing, account). In the relationship between host and guest, these Rental Terms take precedence over the GTC in the event of conflict.

13.2 The parties acknowledge that, in order to fulfil tax reporting obligations, Oazo may transmit booking data (in particular the period, the number of nights and the remuneration credited to the host) to the competent tax authorities (GTC clauses 3.17 and 5.3). Personal data of the guest is not reported.

14. Final provisions

14.1 Should any provision of this contract be invalid, the remaining provisions remain unaffected.

14.2 The German version prevails; translations serve for ease of understanding.
